Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the http://darkhaute.com website (the “Service”) operated by Dark & Haute (“us”, “we”, or “our”).
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
PURCHASES
If you wish to purchase any product made available through the Service, you will be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.
You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.
We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons.
We reserve the right to refuse or cancel your order if fraud or an unauthorised or illegal transaction is suspected.
ORDER & SHIPPING INFORMATION
Once you have placed your order, you will receive a confirmation email. If you do not receive a confirmation email, please email us at hello@darkhaute.comor contact us directly via the 'contact' section of the online store.
If you have not received a shipping confirmation email within 3 business days of placing your order, please email us at hello@darkhaute.com.
PAYMENT METHOD
We use Stripe and PayPal as our gateway payment providers. Via Stripe you can pay with VISA, Mastercard and American Express. Dark & Haute will appear on your credit card statement. All purchase transactions and shipping costs will be calculated and processed in Great British Pounds (GBP).
POSTAGE & HANDLING
Jewellery orders
We offer FREE UK DELIVERY on all jewellery orders.
We offer FREE WORLDWIDE DELIVERY on jewellery orders over 450 GBP.
Your order will be shipped within 2 business days of receipt and will arrive within 1-2 business days at your address.
Delivery times are an estimate only and Dark & Haute will not be liable for any reasonable or unavoidable delay in delivery.
The item will be carefully packaged to ensure that it arrives in pristine condition. If your jewellery arrives damaged, you must notify our team within 48 hours. Email hello@darkhaute.com and you will receive a prompt response.
Art Orders
The “Art” section is being curated at the moment and there are no products currently available to be purchased. In the future, Art orders will be shipped separately (directly from the artist) and shipping costs are calculated by region for each purchase.
DOMESTIC SHIPPING (UNITED KINGDOM) – FOR JEWELLERY ORDERS
All parcels within the United Kingdom are dispatched within 2 business days from date of purchase via Royal Mail’s registered mailing service. It is your responsibility to arrange for re-delivery or pick up from your post office if the parcel cannot be left at the address provided.

In exceptional cases, parcels could take up to 5 business days to arrive once they have been dispatched. Upon dispatch, a tracking number will be emailed to you.

TAXES & DUTIES
All applicable custom fees, taxes and duties are the sole responsibility of the customer. Custom authorities require that we state the value of your order directly on your package. It is at the sole discretion of custom agents to release your package. Please note that in rare occasions custom agents may delay delivery of some packages. Dark & Haute is not responsible for any delays.
CURRENCY CONVERSION
All prices listed on our site are charged to your credit card in Great British Pounds (GBP).The bank that has issued your credit card determines the exchange rate that you will be charged, but it should closely match the official conversation rate at any given time.
STOCK
In the very unlikely event that a product you have purchased is unavailable, we will contact you immediately. If the transaction has been processed, we will reverse the payment. We will then inform you when the product will be available again. For any inquires to this effect, please email hello@darkhaute.com and you will receive a prompt response.
RETURNS AND EXCHANGE POLICY
For hygiene reasons, we are unable to offer exchanges or refunds on any jewellery items bought through our Service.
Please make sure to read the description of each product carefully. We take great care in providing you with all the information required to make an informed purchasing decision. We invest in high-end product photography both for the item alone and worn on a model to show how the piece renders in real life. An exchange or refund can neither be accepted if you have changed your mind, decided you did not like the purchase or had no use for it.
Exchanges or returns are only considered when there is clear indication of a manufacturing fault.
REFUND FAULTY ITEMS
All items are quality checked before they are ready for dispatch. Should you, however, identify a manufacturing fault, please get in touch with us at hello@darkhaute.com within 48 hours of receipt of goods.
All claims for faulty items will be fully inspected before a refund can be issued. The product must be sent back within 5 business days of making a claim for faulty goods. Dark & Haute must receive the product in the original packaging in the exact condition and with the exact same content it was sent out in. It must not have been worn.
If you are issued a refund, it will be credited back onto the credit card that you placed the order with. Once the refund has been issued it can take 3-7 business days to clear in your account.
GOODS THAT HAVE BEEN WORN OVER TIME
Please note that the general wear and tear in the course of normal use is not considered a manufacturing fault. The jewellery containing glass, resin or semi-precious stones is delicate and should be handled carefully. Crystal or glass stones breaking from mishandling is not considered a manufacturing fault. Manufacturing faults do not include cracked or broken stones or if an item has been bent out of shape from wear or if the plating starts to fade.
The Demi-Fine Jewellery is handmade and can be very fragile. If it is dropped it could break or stones could loosen and fall out. If pressure is placed on the earring posts or if they are bent out of shape they can weaken. This can result in breakage. Please ensure to keep your earrings in the original packaging to prevent this from occurring. Dark & Haute Limited is not required to fix items that have been broken or replace stones. This can be done in exceptional cases, but shipping and reshipping cost must be assumed by the customer.
Due to the nature of Gold and Silver plating, and despite us using 18-karat 2-micron Gold plating for our Demi-Fine Jewellery, through the frequency of wear, the plating can rub off and discolour. The metal may become dull over time with wear and when it comes into contact with moisturisers, perfume, hairspray etc. This is a natural part of the wear and tear and is not considered a manufacturing fault.
Please remove your jewellery before swimming or getting into the shower. If the jewellery gets wet, it will tarnish.

VARIANCES IN SEMI PRECIOUS STONES
Natural stones vary in colour, size and shape. Your piece will bear individual characteristics and although equally as beautiful and unique, it may vary slightly from the photograph shown on the website.
Please look at all photos provided of the product to see the variances. If you have a special request for a particular colour, please email the team at hello@darkhaute.com before placing an order.
We are not able to exchange the item bought for a different piece based on the characteristics of the stones. This is an inherent characteristic of the natural materials we are using.
VARIANCES IN FRESH WATER PEARLS
Freshwater Pearls have variances in colour, shape and texture. These variances are what make the pearls beautiful and unique. The piece of jewellery you receive may vary slightly from the photos provided online.
If you have any concerns regarding the nature of variances within the jewellery, please email the team at hello@darkhaute.com before placing your order.
We are not able to exchange the item bought for a different piece based on the characteristics of the natural pearls. This is an inherent characteristic of the natural materials we are using.

If you do not have pierced ears, when purchasing earrings, please make sure to select a product that falls under the category “clip” earrings.
CARE INSTRUCTIONS
The Dark & Haute Demi-Fine Jewellery is handcrafted by skilled artisans throughout Europe, which means each and every piece is unique. The Costume Jewellery is made in the United States. Due to the fragile nature of the jewellery, utmost care must be taken. We recommend all jewellery be cleaned only with a polishing cloth. No detergents or cleaning solutions should be used.
If dropping the jewellery results in damage to the product, this will not be considered a manufacturing fault and will not result in a refund. Damage from careless wear is not Dark & Haute’s responsibility.
Always keep your item stored in a safe place and away from perfume, moisturizer, fake tan and hairspray. Do not wet the metal. Take jewellery off when washing hands, having a shower or swimming.
Due to the nature of Gold and Silver plating, and the frequency of wear, it can rub off and or discolour over time. This is a natural part of the wear and tear and is not considered a manufacturing fault.
Keep in mind, everyone is different, and sometimes your skin may react differently to certain materials. Depending on the acidity level in your skin or the products you use, e.g. moisturiser/fake tan, the jewellery can react and mark the skin. This is not viewed as a fault.
INTELLECTUAL PROPERTY
The Service and its original content, features and functionality are and will remain the exclusive property of Dark & Haute Limited.
AVAILABILITY, ERRORS AND INACCURACIES
We are constantly updating our product offering and related services. The products or services available through the Service may be mispriced, described inaccurately, or unavailable, and we may experience delays in updating information on the Dark & Haute website, our social media platforms or other advertising channels.
We cannot and do not guarantee the accuracy or completeness of any information, including prices, specifications, availability and associated services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.
CHANGES
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
